Depraved heart murder is criminal recklessness. You don't intent to kill, but your actions are so reckless that if someone dies you should be tried for murder. It would be like if someone shot up a house, not thinking anyone was home but whoops, a whole family was inside and you just hit one of them in the head.

The weakness in the State's case is that there is no direct evidence to establish that the child's killing was done with malice aforethought. If the child was killed in an angry rage or by the defendant's gross negligence or recklessness, it would be a homicide lesser than murder1. The conduct after the killing does not establish intent. Duct tape and chloroform may if obtained prior to killing, may prove malice.

Prosecution's rebuttal should be interesting in this regard. Given how the rest of the trial's gone, I wouldn't be surprised to see them blow a couple other things out of the water.
