I was thinking more along these lines:
I agree that he shouldn't be sleeping in the lobby. I lived in NYC and Chicago for years. I've dealth with a lot of homeless people, and I would definitely have been very unhappy if one of them had decided the foyer to my building was his or her domicile.
It was the little "fairness" gibe I was taking issue with.
