Sons were 11 and 12.
Happened in Texas. Usually I'm not for vigilante justice, but I won't be shedding a tear over a drunk driver who's now 6 feet under after killing a couple kids.
Texas man David Barajas has been charged with murder in the fatal shooting at a crash scene of suspected drunk driver Jose Banda who authorities say plowed into his sons.

so was he already dead when he shot him?
I hope that dude likes prison.
Bring back Rich Rod!
No, cops are ruling this as a homicide.
Do you put it past a jury in rural Texas to let this guy go? If he has a good defense lawyer it could happen.
Terrible. Can't condone the murder. I understand it, but can't make it okay.
One of his sons was still alive when he went into the house to get a gun.
So they were in the middle of a rural road in the dark pushing a car? Yikes.
This is way different than some situations we've seen in Texas with justifiable homicide. This was just straight up murder, execution style. Certainly, anything is possible in Texas, but I can't see any way this guy doesn't go to jail for awhile.

I do not support it but I understand it.
Yeah there's a reason Jesus repudiated the "eye for an eye" stuff.
Not to Wells it up and I'm no longer a Christian, but the old testament said that. When Jesus came, he taught turn the other cheek. That said, I support this guy.
Fuck that guy. Lets his truck run out of gas, has his young boys help him push it on a dark road, then takes the effort to shoot the other driver instead of trying to save the one son who was still alive
"Investigators believe Banda had been drinking before the crash, and they're awaiting the results of blood tests on him."
Wow, it might be a little early to call this drunk driving. They haven't proven it yet.
Dominating Press Conferences Since 2007
‘It was an accident. He didn't purposely do that,’ Tellez told ABC13. 'Whoever did it is getting away with murdering my nephew. He deserves justice.’
It's quotes like this that piss me the fuck off. The dumbass made a conscious decision to consume alcohol and get behind the wheel of the car. This wasn't an accident, it was negligence.
Had the dad not taken the matter into his own hands, the driver of the car would have been locked up for a long time as well.
I have no problem with it.
Exactly what I thought when I read the article. Does anyone know if he even had his hazards on?
Id argue the dude making his sons push a truck in the middle of a dark road is negligent too.
Still awaiting the test results.
They don't know if it was drunk driving or not. Let's work with the facts here before jumping to conclusions.
Of course the "journalism" here is abhorrent, with the headlines stating he is a drunk driver before we even know.
I agree that he was negligent as well.
He will go to jail and rightfully so, I'm just saying I don't have a problem with it.
This article says that Banda had a BAC of .175.

Officials say an arrest has been made in the shooting death of the driver who killed two young boys in an accident in Alvin in December.

You also realize that sober people have accidents, sometimes resulting in death? While drunk driving increases the risk of having an accident, I'm sure there are a substantial number of accidents where alcohol was in the driver's system but not a necessary condition for he accident to occur. I'm still not sure why everyone seems to be so much more enraged by drunk driving than inattentive driving.
Hopefully he does go to jail. Hopefully the prosecutor isn't over zealous and push for murder 1. Yes, the father did go home to get his gun, return to the scene, and kill the drunk driver. But I couldn't imagine what state of mind he was in after seeing his 11 year old boy crushed to death in front of his face and his other son mangled to the point of barely alive.
If he has a good defense attorney I could see him getting off light.
I feel horrible for his wife and daughter. In about 5 minutes two members of their family died and another one committed a capitol offense.
You know me, and while it is sad, I can say that I might consider the same action if I was in his shoes.
