They can try and only if Dad is clearly and convincingly found to be unfit, will he lose custodial rights. Otherwise, it's a parenting time issue.

What a horrible situation. I just hope her little boy comes out of this OK.
Makes you think maybe we could all be nicer to each other sometimes.
I think some were jumping to conclusions and starting to spread rumors. I think we ought to wait and see how it all plays out.
Keeping the sunshiners in check since 2000.
Very, very sad news. Way too young.
Have not read the entire thread. She took a lot of abuse here but never seemed retaliatory in defending her threads/posts. Perhaps tRCMB could take some posting lessons from her, in her memory.
Prayers for her family. And, hope that the Court system makes the correct custody judgment for the future of her son.
Rest in peace, Ashley
Ah geez, what a huge bummer. It's easy to forget that everybody here are real people with real lives and problems.
Very sad to hear all of these details emerging.
I've always wondered how many posters have died and gone unnoticed...
Clear and convincing unfit and prepondeance in child's best interests here in AZ

OK I had a chance to briefly talk with her Mom on facebook today....I feel so badly for that lady. Anyway I told her that there was a large group of mutual friends (RCMB) that want to help out when there is a fund or something set up. She was very touched and will keep me updated. I'll get a seperate thread going soon.
I need more room for my signature
Good. I think there are many good people on here that will give something to help a fund for Ashley's son.
Maybe trevor could set something up where a certain % of the subscriptions over the next few months/year could go to setting up a scholarship fund for her son.
hoke- to alter or manipulate so as to give a deceptively or superficially improved quality or value.
Truly sad. I am stunned. Not what I expected tonight when I decided to check the board.
I will keep her family and young son in my prayers.
The grandparents don't have standing to do anything except ask for parenting time. If CPS charges him with neglect, the grandparents can petition for custody.
Don't think -- it can only hurt the ballclub
Possible interesting twist in the court records. In October Ashley filed a Motion to Modify Parenting Time, but it doesn't appear that the motion was heard. Normally there would be an entry of a motion hearing or a referral to the Friend of the Court within a couple of weeks.
Will this be a trust that the child takes control of at 18 or something the dad will control? How do these things work?
Depends on how they set it up. If the grandparents are creating it, considering what we are finding out I am guessing they will make it a trust that the child takes control of at 18 or older and the grandparents will have control over it until then.
Posting member of tRCMB since 1997.
It is ALWAYS a great day to be a Spartan!!!!
Sorry to hear this news. Condolences to her family, and may she find peace wherever she is.
Random observation. This thread maybe should be locked soon.

OK. Time to lock it up.
I have no idea. It should be left open at least until her service.
It's been requested that I lock the thread so I'm going to.
