well see how fair the EL judicial system is towards students. i was pulled over with over an oz in the car and got the same citation. was able to plead it down to a $300 fine. in this case, it's going to be about how much was in the car.

Couple things:
Its not operating in the presence of drugs---
Its operating with the presence of drugs. That means that THC has to be found in the blood stream.
Even worse - its a strict liability offense. Impairment has nothing to do with it.
To clarify it is the same offense type as regular drunk driving.
Its 257.6252- OWI vs. 257.6258 OWI w/presence.
Its still a 93 day misd.
Possession of Marijuana is a 1 year misdemeanor.
Both will likely result in a probationary sentence- the OWI will never be able to come off his record though. While he can hopefully take advantage of a 333.7411 sentence and have the Poss MJ taken off his record after he successfully completes probation.

also im not sure how much it effects Nix's case, but I know if he was on campus, its a lot harder to plead everything down and they take possesion/substance problems very seriously. Hopefully he was off campus
