EL police patrolling off-campus tailgate areas

    At the Lutheran church? That's where we've tailgated for about 5 years as well. Kinda killed the festive atmosphere. At least the attendants came around and warned everyone first.

    Maybe the church is actually in favor of the ordinance. That's a possibility.

  • Yup - we are in the church lot. We are on the grassy area in the reserved spots - can really spread out and set up a camp. Its a great spot to tailgate with a crowd. The people around us have been tailgating there for years as well, so its become a nice large tailgating community. Would we give this up because we can no longer drink? I doubt it. But again the question - why now? It has always been illegal. I have no problem with them writing tickets to people walking the streets carrying open booze. But why bother gatherings where these is absolutely no history of troubled behavior? This isn't Cedar Street littered with drunk students. This is mostly families, alums, etc.

    I'm comparing open alcohol in general.

    When was the EL ordinance passed (did a quick google search but can't find the date)? Your guess that it has to do with post-game football seems like a pretty specific case for such a broad law - you'd think it'd be only on game days if that was the purpose. The State of MI also has its own open intox law, doesn't it?

    shrug I don't know. The attendant that warned us before the cops showed up was almost apologetic. It's never been rowdy there, and pretty much all the regulars get along. They'll probably lose most of the people that set up tailgates, but they can fill those lost spaces in easily. The lot is always full a good hour before kickoff.

    I suspect it has to do with containment, and having large tent style parties open up in parking lots that cannot be contained.

  • I wonder if the "next game" warning had anything to do with the next home game being CMU, knowing a ton of kids will be in town, and is more a shot to the lot owner's than anything else. A pre-emptive strike for riot control with a return to normal, non enforcement the rest of the season.

    "Sec. 26-54. - Possession of open container of alcoholic liquor in public place.

    Thus, the question seems to turn on whether or not the subject lot is "open to the general public", if it is a small lot that he turns over to a single group for tailgating, or certain repeat tailgaters whom he knows in advance, he would have an argument it is not "open to the general public". More needed.

    I think that's the point being made here. Technically, yes. He's breaking the law. But it would suck ass if the popo pulled everyone over who goes 3-5 miles an hour over the speed limit.

    I think there's always a delayed effect because people tend to not think about policies until they're affected by them. So I don't think new policies necessarily affect ticket sales in the same season.

    But I can tell you with certainty that people who are issued a $600 ticket for drinking in a private lot will absolutely reconsider whether going to games is worth the time and hassle in the future.

    I got a $500 open intox ticket in Evanston in 2008. Didn't stop me from going back there last year for the game. Just put my beer in a plastic cup.

    Pylon, have one of the kids posted out on the road with a whistle and when the cops are approaching have a rubbermaid container where you can put the open containers in. after they pull away keep on keepin' on.

    There aren't any residents around us. We're directly behind Goodrich's. There's the Red Cedar Elementary school to one side, the church to the other, and a sizeable hedgerow to the north. Maybe the houses past te hedgerow are bitching? But again, I've never witnessed anyone getting overly loud. I think it might be as simple as the ELPD trying to bring in more fine $$$.

    PS Methinks you have your streets confused, there is a large chunk of houses just to the south of "your" tailgate spot on Sever Rd, to the west along Narcissus Dr, and directly behind the parking lot for the Islamic Center on Daisy Lane. The only way you are right next to Goodrich's is if you are actually at the University United Methodist Church and not the University Lutheran Church as you claimed earlier. Even if you are at the Metodist Church those houses on Sever Rd are still right there....

  • I guess what I don't understand about this stupid law is, why does EL think it has the right to pass a law banning adults from drinking alcoholic beverages on private property? Walking down a public street with an open can, I guess I can sorta see that, but in a PRIVATE parking lot? That is overreaching on EL's part as far as I am concerned and I don't think it could stand as constitutional if someone decided to challenge it. That said, I don't tailgate anymore because it got to be to much hassle. Now the wife and I just go to a restaurant. Much easier.
