    All they'd really have to do is use "Fab 5" instead of "Fab Five" and Rose wouldn't have a legal complaint at all.

  • I don't know what business he's involved in but a trademark is for conducting business hence the word "trade" in the word. You can't just sit around on a group of words, you have to be actively using it in a business or you lose your rights to them. And that business is for a specific type of business. You can have "Fab Five " Garbage Removal, right next to "Fab Five" Pawn Shop, next to "Fab Five" Liquor Store and they can all use the name.

    He registered it a while ago for a media company he was trying to start. It went dead after a while. He just registered it again late 2011 to use market clothing. When that idea doesn't take off the trademark ownership will die again. I'm not sure the time line though.

    But you are basically correct.
