Maryland to the B1G, press conference on BTN at 2:30pm

    I don't see what there is to negotiate. UMD signed a contract (which IIRC is guaranteed). The only 'defense' Maryland has is that they will take them to court; or is there something I'm missing?

    I don't know what they have either but it appears that Maryland thinks they have something...that, or UnderArmor money.

    The RCMB...is one of the most awful, alarming, inappropriate, disgusting, and offensive msg boards in the history of the internet.

    Boner inducing. Football is questionable but they are both rich ass schools that increase research power 10 fold. Let the other conferences fight for the Louisvilles of the world.

    An exit fee is liquidated damages for breaking a contract. If they are reasonable, they can be imposed. If not, if they are punitive, they can't.

    I can't think of a high D-I school that has moved since this started that has conformed to the stated exit criteria.

    They wouldn't get out with zero unless the league fell apart. But they won't pay 50 mil, either.

    It's not about Maryland. It's about everyone else in the ACC. If Maryland gets their fee reduced substantially, it will be open season on everyone else.

    In these crazypants days of realignment, the best thing a conference can do to solidify its membership is to sign a big, juicy TV contract. The ACC failed at that, so they did the next best thing: they raised the exit fee to $50 million dollars.

  • Will settle out of court for an undisclosed sum of $$$$ and a Confidentiality clause. I.E. MD will get out for far less than the increased fee but the ACC will not have to disclose that fact.

    ACC desperately trying to hold that conference together. The new big east is a joke. 8 former conference USA teams, 2 from MWC and 1 from the Mac. When the ACC implodes, Notre Dame will be left holding the bag.

    Link or is this just your prediction? All I'm seeing is that the lawsuit was just filed.

    I'm not so sure about settling out of court on this one. The ACC is under attack and even a confidentiality clause won't save them. Everyone will know that if Maryland is able to pay it, it must have been substantially less. And if it's substantially less, other schools will challenge the same thing in the ACC if they want to leave. Plus, wouldn't something like the amount they paid have to be disclosed by Maryland since they are a public university?

    the ACC voted on raising the exit fee to $50MM, which Maryland voted against. They and FSU were the only ones to vote against it. (UVA could be in trouble because of that).

    the key points though, are that:

    1. Contract law doesn't allow for penalties
    2. Liquidated damages are allowed, but the party must agree to them in order to be bound by them.

    So, Maryland would pay the old exit fee of $20MM
