Talk to me about getting evicted

    Also why are you renting? I thought all the ballers on the RCMB were posting from their mansion they payed cash for. Unless this is a vacation rental?

  • Seriously though, will getting evicted affect his credit? If not, sure, moving is a pain, but it seems like it'd be easy enough to just find a new place.

    I assume it would; late payment on a rental fee. The details about the dog and a minor maintaince fee will be lost when the bank checks his credit report. It'll just show up as a late payment resulting in eviction.

    (these are assumtions, I'm not a lawyer)

  • One positive thing in the middle of all the responses - you're incredibly brave to take this question on the board. You must have known that you weren't going to exactly meet with piles of sympathy, right?

    I'd like to join the mob of people asking why you didn't just pick up the dog crap or pay the fine in the first place. Is it a laziness thing, an "avoid the issue" thing, or a "I'm not cleaning up after my lazy ass roommate's annoying dog" thing?

    Probably not. Landlords don't report on-time/late payments, so that doesn't matter. If they have an outstanding balance with the landlord and don't pay it, then the landlord will go to court and get a judgment, which then would mess up his credit (and prevent him from ever getting a loan until it's paid). Theoretically, a judgment can be used to garnish wages, but unless it's a big judgment against someone with a steady income, it'd doubtful they'd even bother with that.

    The OP should get an "all paid as agreed" letter from the landlord...if he can get that, he should do whatever the landlord wants (including move out if thats what they want). He needs to get on better terms with the landlord to avoid some BS damages too...his responsibility is NOT limited to the security deposit.

    Trust me when I say they don't need to go to court to F up your credit. Apparently Due process is no longer a constitutional right when it comes to scamlords.

    In my experience, they really don't care as long as they think you can pay now. It's not tubad.

    Ok, so then it will affect his credit...to a degree. Maybe not his score, but it would be noted on the report. That's kinda what I was wondering. I know if you leave a lease early and don't pay the remaining months, it can affect your credit. I figured there'd be some sort of repercussion if you are evicted.

    If he's not being evicted for money owed, if there's no judgment, and he leaves the apartment in good standing financially, then it won't affect his credit. However, with an eviction, it's going to be difficult to get approved for another apartment anytime soon. For any reputable property management company, an eviction is an automatic denial, and they're going to find this when they run their background checks. The OP's best bet would be to try to rent through a private landlord who are typically much looser on policy and approval procedures, or get ready to go to battle and state his case to the property manager, bring documentation, etc.

  • There is no more to this story than the dog shit. We were warned, fined, and then the fine was late. Simple as that...I've accepted that my room mate and I are douches so these response are of no surprise. I skipped my lunch break at work to talk to them but the lady I needed to see had the day off, I'm going to talk them on my lunch break tomorrow. If they won't budge I'll offer to put in some service time cleaning the rest of the complex up because nobody else picks up their shit either....maybe that will be enough to let us stay.

    I really don't want to get involved in court. If they want to go through with it then I will find somewhere to stay for a few weeks.
