What are the penalties for pot in Michigan?

    I got caught in high school with a quarter and all that happened to me was that I got expelled. Went to court and they dropped the charge. Had to pay a court fee and change high schools. Never talked to anyone from that school ever again and ended up meeting my now best friends where I ended up finishing high school at... I know, I know, cool story.

  • get a lawyer and plead for the holmes youthful act. I did that 5+ years ago. Dont know if they still have it or not. Everything was expunged after a certan amount of time.

    I didnt have a lawyer though so I think I got fugged on fines and I had to go to a offenders thing for a weekend that was terrible.

    You would be correct. This girl wanted to smoke after school and I figured a quarter would be enough (at 14 I thought I'd look cooler showing up with that much compared to just a blunt or something)...

    Yes, HYTA is one possible option, if his kid has had no previous trouble. Where did he get busted? It matters because some counties have judges and prosecutors who are tougher to work with than their counterparts in other counties. A criminal defense lawyer is the best way to go. If he's a full-time MSU student, a good first-step is ASMSU Student Legal Services.

    lol good answer, I'll stay honest- I said I was TRYING to be cool. She was in my grade. Life would've been great if I were pounding some 18 year old vag when I was 14.

    Fortunately, he got busted during my ex's parenting time. She called to tell me what happened after picking him up at the PD. I questioned where he got the money to buy it. She replied, "I gave him $250 for Christmas".

    yep. I think the camp I went to was somewhere around Big Rapids. Is that where you are going?

    Some of it actually kind of cool like ropes courses and rock climbing walls with caribeaners. Others sucked like depending on a bunch of hs dropouts to do memory games. Its basically all team building exercises.

    It just sucked because you were with a bunch of fuck ups who suck, no tv, internet, cell phone. And paying like $500 or whatever it costs.

    One guy in my cabin actually brought weed and smoked it with some people there before we started the day. It was my first time on probation and had no idea I would never have to report so I passed.

    If he doesn't have a card, than he is at risk of being charged with intent to distribute if he was carrying over 28 grams on him when caught..

    Intent to distribute is a felony and a possible jail sentence. Hopefully it was under 28 grams, if so then it wont be a felony and probation will take its course.

  • I honestly think the kid will be fine. I feel it's a lot different now that there are so many people out there with cards and stuff. Especially if he's a teen whose never been in trouble before

  • Possession of Marijuana is a state crime- so its not really going to vary by city.
    Some cities/townships/municipalities may charge the person with possession of drug paraphernalia- even though the paraphernalia is the marijuana. The only difference will be how the jurisdiction treats the resulting offense.

    Having a med card/certificate wont make a bit of difference because he/she didnt have it BEFORE he/she was arrested.

    Poss. of Marijuana - MCL 333.7403 - 1 yr misdemeanor.
    Poss w/intent to Distribute - 4 yr. felony.

    Though generally an ounce will be considered personal use- there can be other circumstances that indicate intent to distribute.

    If this is a first drug related crime and he/she is charged with possession (misdemeanor) - your kid will likely be able to plea under 333.7411 or HYTA.
    7411 is available for any age any first offense possession (not PWID) drug crime.
    HYTA is available for most crime for any offender under the age of 21.

    Either way- both are classifications that are discretionary to the judge.
    Likely will require a period of probation 6-12 months, which will likely include drug testing/drug classes aa/na court fines and probation supervision fee's.

    Theres the potential for a plea to USE of marijuana (333.7404) and 7411/HYTA- which will cut down the severity of fines and costs- and its only a 90 day misdemeanor so if kid was to get in trouble again it limits the jail exposure.

    Also the conviction of a drug crime comes with a brief suspension of driving privileges by the secretary of state. (Im not sure exactly what those terms are or the impact of HYTA/7411)
