    The argument I've seen from the sports law guys is that the lack of control is letting the football coach essentially make decisions that should be made by the President on behalf of the university, or at least the AD.

    This is breaking new ground into the subject of lack of institutional control.

    I don't think anyone can argue what went on at PSU fits the bill.

    If you let the football coach make decisions that should be made by the president, that's lack of institutional control. It was not Paterno's decision to make. It was the president's decision to make in his position as representative of the university. This particular factual situation is not one that has really come up before, thank goodness. So in that sense, new ground will be broken one way or another.
